An application to the Court of Protection is an application to court for permission to deal with the property, financial affairs and personal welfare of a person who is deemed to lack the mental capacity to make decisions if there is no existing Lasting Power of Attorney in place.

 

  If someone loses mental capacity without having a Lasting Power of Attorney in place, then it can be a daunting prospect to begin to deal with their affairs.
